    Environmental Permits – Enabling your Operation

    Environmental Permits replaced waste management licenses and PPC permits: they control any activity that may pollute the environment or affect drainage and flood risk adversely, such as waste operations.

    You cannot operate a waste facility legally without the correct permit and you cannot undertake legal waste operations  outside the permit boundary.

    Before a permit can be issued you must supply the Environment Agency with documents that satisfy all their requirements. The documents outline how your facility/operation will comply with current legislation.

    Permit applications are complex and the process is lengthy. The criteria the Environment Agency use to assess your documents may change as an application is processed so you can expect lots of liaison and some fine tuning.

    Environmental Management Systems – documenting and designing environmental protection

    The design and operation of your facility and how you perform waste activities must be compliant to make sure you protect the environment throughout the life of your permit: polluting the environment can lead to large fines.

    Fire Protection Plan

    All new Environmental Permits must have a Fire Protection Plan (FPP). This is a detailed document explaining:

    • the nature of your site operations and the potential fire risk
    • how the design of your site minimises the risk of fire outbreak
    • the procedures and mechanisms you will use to contain a fire

    A successful FPP requires scrupulous attention to detail; you must prove your site is fit to withstand a worst case scenario fire, defined by  the Environment Agency.

    To satisfy the Environment Agency that your facility if safe to operate you must provide and/or store enough water (or an approved alternative medium) to douse the fire.

    Your site must be engineered appropriately so that all the water (or other dousing medium) used to fight a fire can be contained without risk to the environment.

    Recovery Operations

    It is possible to use specified waste in a Recovery Operation if the Environment Agency agree the activity is not a ‘Disposal Operation’ (e.g. a landfill) .

    For example:

    if your planning permission says you must reinstate your working site progressively because it is within an Area of Outstanding Natural Beauty, or an Area of Great Landscape Value;

    OR

    if you can provide a business plan (or equivalent) to prove you could still make a profit even if you used primary aggregates for the intended operation.

    We have helped clients to obtain Recovery Permits for both these scenarios, starting with an effective Recovery Plan.
